No instale o utilice el software antes de leer y aceptar todas las condiciones de la licencia. La autorización para utilizar el software depende de su aceptación de las condiciones de la licencia. La instalación o utilización del software implica la aceptación por su parte de las condiciones de la licencia. La aceptación le obliga a cumplir las condiciones de la licencia en un contrato con CyberLink Corp. que puede llegar a legalizarse.

*ACTIVACIÓN DEL CÓDEC
Cuando utilice por primera vez ciertas tecnologías esenciales para las funciones multimedia, la aplicación de software recopilará el número de serie de su sistema informático y la clave de producto (clave de CD) únicamente para fines de activación.

*POLÍTICA DE PRIVACIDAD
Algunos de nuestros productos pueden enviar un evento/señal anónimo al servidor de base de datos de CyberLink para recopilar información con el fin de mejorar la experiencia del usuario final, como, por ejemplo:
-Cuando el usuario acepta o rechaza el CEIP (CyberLink Experience Improvement Program, Programa de mejora de la experiencia de CyberLink)/CPIP (CyberLink Product Improvement Program, Programa de mejora del producto de CyberLink); y
-Cuando nuestro producto se instala y/o se desinstala.

Tenga en cuenta que una versión de prueba también podría recopilar información anónima y/o enviar informes de bloqueo de manera inadvertida al servidor de CyberLink para el programa de mejora del producto.

*SERVICIOS RELACIONADOS

* LICENCIA DEL SOFTWARE Y GARANTÍA LIMITADA
Esto es un acuerdo entre usted, el usuario último y CyberLink Corp. ("CyberLink"). Al utilizar este software, acepta estar obligado a cumplir las condiciones de este acuerdo.

Si acepta cumplir con estas condiciones, haga clic en "Sí". SI NO ACEPTA LAS CONDICIONES DE ESTE ACUERDO, NO UTILICE ESTE SOFTWARE Y ELIMÍNELO DE SU ORDENADOR INMEDIATAMENTE.

* CONCESIÓN DE LICENCIA Y RESTRICCIONES DE USO
A continuación se incluyen las condiciones generales de licencia y las restricciones de uso seguidas de especificaciones concretas dependiendo del tipo de licencia que tenga.
CyberLink, como concedente, le concede, al titular de la licencia, un derecho no exclusivo de descargar y/o instalar el(los) programas de software de PowerDirector que acompaña(n) (de aquí en adelante el "SOFTWARE") en un determinado número de ordenadores/dispositivos de acuerdo con el número de licencias que haya adquirido y usar el SOFTWARE conforme a las condiciones de esta licencia. Usted acepta y confirma que puede recibir avisos de actualización y mejora del SOFTWARE o cualquier mensaje electrónico comercial durante el uso del SOFTWARE. Queda prohibido alquilar, transferir, licenciar, modificar, alterar, manipular, desmontar, descompilar o crear cualquier trabajo resultante del SOFTWARE, o eliminar nota alguna de los derechos de copia (copyright) o leyenda de patentes contenida en el SOFTWARE. También se prohíbe la reproducción del SOFTWARE a menos que sea por razones de copia de seguridad pudiendo haber una única copia. Usted acepta que la licencia de este SOFTWARE se confiere a su persona, sin que ello implique su venta. El SOFTWARE debe adquirirse de forma legal a través de CyberLink o de los proveedores autorizados por CyberLink, ya que en caso contrario no tendrá derecho a utilizar el SOFTWARE. Usted acepta que una vez que haga funcionar, utilice o instale el SOFTWARE, no podrá revenderlo ni distribuirlo a ninguna otra persona o entidad de acuerdo con la normativa correspondiente. El hecho de que tenga permiso legal para revender el SOFTWARE dependerá de la ley de su lugar de residencia y de dónde se encuentre la persona a la que le vaya a transferir el software. Normalmente, una reventa o distribución ocasionaría el cese automático de su licencia respecto al uso del SOFTWARE. Usted es el único responsable de los riesgos de no poder usar o instalar el SOFTWARE al NO comprar u obtener el SOFTWARE de CyberLink o de distribuidores o vendedores autorizados por CyberLink, o bien de utilizar SOFTWARE usado. Tipos de licencia:
**LICENCIA INDIVIDUAL
Si adquiere el SOFTWARE con una licencia individual, es para su propio uso según los términos generales descritos anteriormente.
**LICENCIA DE SITIO
La licencia de sitio solo permite utilizar el SOFTWARE en una única ubicación. El número máximo de usuarios está limitado por el acuerdo de la licencia de sitio.
**LICENCIA DE VOLUMEN
Solo se puede instalar una copia por dispositivo. Si usted es titular de una licencia de volumen, puede realizar varias copias de seguridad e instalar múltiples copias del SOFTWARE. El número total de copias permitidas se limitará a número máximo según la cantidad adquirida.
**LICENCIA DE EVALUACIÓN/PRUEBA
Solo se puede instalar una copia por dispositivo. El SOFTWARE se concede bajo licencia únicamente para fines de evaluación y/o prueba. Los derechos que se conceden en esta licencia cesarán tras un periodo de tiempo concreto y el SOFTWARE solo se podrá utilizar durante un tiempo limitado, después del cual puede quedar deshabilitado. Esta licencia es solo para uso no comercial.
**LICENCIA DE SUSCRIPCIÓN
El SOFTWARE se concede bajo licencia para fines de suscripción. Usted acepta que CyberLink pueda cambiar la versión del SOFTWARE proporcionado en cualquier momento sin que ello suponga ninguna responsabilidad ante usted. El acceso continuado al SOFTWARE de suscripción requiere disponer de una conexión a Internet activa, la recepción por parte de CyberLink de los pagos de suscripción recurrentes y la aceptación de las condiciones de uso y/o servicio del SOFTWARE de suscripción que se encuentra en el sitio de descarga. Los derechos que se conceden en esta licencia cesarán tras un periodo de tiempo concreto y el SOFTWARE solo se podrá utilizar durante un tiempo limitado, después del cual puede quedar deshabilitado.
**LICENCIA EDUCATIVA
El SOFTWARE se concede bajo licencia únicamente para fines educativos y no comerciales. Puede ser adquirida por colegios, universidades, alumnos y sus tutores legales, facultades, profesores, catedráticos, conferenciantes y cualquier otra institución, especialista o personal educativo.
**LICENCIA DE H.265/HEVC
Tenga en cuenta que su SOFTWARE no incluye el códec H.265/HEVC en el momento de la venta o la instalación, lo que significa que el SOFTWARE aún no se considera un producto con licencia HEVC. Para permitir el uso del formato H.265/HEVC, tiene que descargar e instalar las Extensiones de vídeo HEVC siguiendo las instrucciones del SOFTWARE.

**REQUISITOS DE LICENCIA ADICIONALES
Si va a utilizar el SOFTWARE para generar sus propios ingresos o como recurso principal para la generación de sus propios ingresos, necesitará licencias adicionales para las tecnologías de terceros que aparecen en la siguiente lista no exhaustiva:

* PROPIEDAD DEL SOFTWARE.
CyberLink mantiene el copyright, título y propiedad del SOFTWARE y el material escrito ("Documentación") sin tener en cuenta la forma o medios en los que puedan existir el original y otras copias.

* ACTUALIZACIONES.
Si esta copia del SOFTWARE es una actualización de una versión anterior del mismo, se considerará como un intercambio de licencia. Usted acepta con la instalación y uso de esta copia del SOFTWARE que se anula voluntariamente su anterior EULA y que no continuará utilizando la versión anterior del SOFTWARE ni la traspasará ni distribuirá a otra persona o entidad.

* UTILIZACIÓN DE CONTENIDO MULTIMEDIA LICENCIADO POR TERCEROS O CYBERLINK
Puede utilizar plantillas, imágenes, fotos, audio, vídeo, miniaturas o cualquier otro contenido multimedia (“Contenido multimedia”), si lo hay, incluido en el SOFTWARE, que pueda haber sido licenciado por terceros o por CyberLink, para mostrar, completar o cargar la obra que haya creado mediante el uso del SOFTWARE en plataformas multimedia sociales, siempre y cuando:
- el Contenido multimedia se mantenga en uso en el SOFTWARE;
- no utilice el Contenido multimedia de ninguna manera ilegal, de representación pública, comercial o inmoral;
- no retrate en el Contenido multimedia a una persona de una manera que pueda resultar ofensiva desde un punto de vista razonable, incluyendo, entre otras cosas, en relación con la pornografía, los servicios de citas, la promoción de productos de tabaco, las muestras de apoyo a un partido político o la opinión, un trastorno físico o mental;
- no revenda, redistribuya, sublicencie, ofrezca acceso, comparta, transfiera o conceda el derecho de uso a cualquier tercero, salvo que así se especifique en este EULA;
- no utilice ningún Contenido multimedia (en su totalidad o en parte) como marca comercial, marca de servicio, logotipo u otra indicación de origen, o como parte de dicho elemento;
- no haga suponer erróneamente, de manera expresa o mediante una implicación razonable, que el Contenido multimedia ha sido creado por usted o por una persona distinta del titular de los derechos de autor de dicho Contenido multimedia, y/o
- no utilice el Contenido multimedia en relación con una galería de contenido desde la cual las personas puedan buscar, descubrir y usar el Contenido multimedia sin cambios.
CyberLink no ofrece garantía alguna para el Contenido multimedia y rechaza cualquier responsabilidad en la máxima medida que permita la ley. Recuerde que el uso de contenido multimedia está sujeto a su compra del SOFTWARE o de una suscripción válida.

* UTILIZACIÓN DEL CONTENIDO LICENCIADO POR GETTY IMAGES (US), INC.
Siempre y cuando cumpla las siguientes disposiciones, podrá usar el contenido licenciado por Getty Images (US), Inc. a través del SOFTWARE («Contenido de Getty Images»), o cualquier parte del mismo, únicamente como incorporación a los productos digitales creados por usted utilizando el SOFTWARE.
Puede descargar una versión de baja resolución con marca de agua del Contenido de Getty Images sin cargo, solo con fines de evaluación, durante un período de hasta treinta (30) días después de que lo descargue. A menos que adquiera licencias de Contenido de Getty Images, no puede utilizar ningún Contenido de Getty Images en ningún material final ni en ningún material disponible públicamente.
Es posible que tenga que pagar por una versión de alta resolución sin marcas de agua del contenido de Getty Images. Cuando haya comprado la licencia de un Contenido de Getty Images específica a través del SOFTWARE al pagar las tarifas correspondientes, puede usar dicho Contenido de Getty Images con licencia una cantidad ilimitada de veces dentro del SOFTWARE y los trabajos que usted pueda crear utilizando el SOFTWARE de conformidad con los términos de este EULA.
No puede eliminar ningún metadato en el Contenido de Getty Images, activar la función de «clic derecho» en el Contenido de Getty Images, o realizar ingeniería inversa, descompilar o demontar el SOFTWARE para poder descargar o usar el Contenido de Getty Images de forma independiente. Si es técnicamente posible, debe deshabilitar la función de «clic derecho» en todos los elementos del Contenido de Getty Images. No puede utilizar el Contenido de Getty Images de ninguna forma que permita a otras personas descargar, extraer o redistribuir el Contenido de Getty Images como un archivo independiente (es decir, solo el propio archivo de contenido, separado de los trabajos que usted crea con el SOFTWARE o el uso final).
Solo puede usar el Contenido de Getty Images en los trabajos que usted crea con el SOFTWARE, para mostrarlos únicamente en forma digital. No puede vender, revender, distribuir, modificar, reutilizar, mostrar, reproducir o utilizar de cualquier otra forma el Contenido de Getty Images.
El Contenido de Getty Images se puede utilizar en obras no editoriales creadas con el SOFTWARE más de una vez o en relación con dicha obra no editorial, siempre y cuando dicho uso cumpla con este EULA.
El Contenido de Getty Images utilizado en un contexto editorial debe incluir la siguiente línea de créditos: "[Nombre del fotógrafo]/[Nombre de la colección]/[Getty Images o iStock]".
El contenido de Getty Images no se puede utilizar:
- con fines pornográficos, difamatorios u otros fines ilegales;
- de forma independiente sin otro contenido;
- en plantillas electrónicas que se utilizan para crear productos electrónicos o impresos;
- en productos minoristas físicos o digitales, como tarjetas electrónicas, calendarios, carteles o protectores de pantalla;
- con el fin de permitir el intercambio de archivos de imagen; o
- en logotipos, marcas comerciales, marcas de servicios o cualquier otra marca o identificadores.
Si utiliza Contenido de Getty Images donde aparece una persona en relación con un tema confidencial, desfavorable o controvertido, debe incluir una declaración de que el Contenido de Getty Images solamente tiene fines ilustrativos y la persona es un modelo.
No se le otorga la propiedad ni los derechos de autor del contenido de Getty Images.
Si utiliza de forma indebida cualquier Contenido de Getty Images, CyberLink hará cumplir los términos de este EULA, investigará y tratará dicho uso indebido, ya sea cerrando su acceso y/o como corresponda en el caso concreto.
Usted también tiene autorización para usar el contenido musical/soundstripe licenciado por Getty Images (US), Inc. a través del SOFTWARE (“Contenido de Getty Music”) únicamente como incorporación a las obras digitales creadas mediante su uso del SOFTWARE. Tendrá los mismos derechos de uso del Contenido de Getty Music que se establecen para el Contenido de Getty Images, teniendo en cuenta que, sin embargo, (i) además de los términos establecidos anteriormente, no puede en ningún caso usar el Contenido de Getty Music en contra de las restricciones establecidas en la Sección 3 del Acuerdo de licencia de Getty Image Music (véase: https://www.gettyimages.com/eula) y (ii) no puede usar el Contenido de Getty Music en ningún producto para su reventa o para plantillas electrónicas (incluidas plantillas de video).

* USO DE DERIVADOS DEL MODELO DE DIFUSIÓN ESTABLE
En nuestro Servicio con modelos de Difusión estable, se aplican las siguientes restricciones de uso (para más información sobre los términos de la Licencia de difusión estable, consulte: https://huggingface.co/spaces/CompVis/stable-diffusion-license). Usted acepta no utilizar nuestro Servicio:
- De ningún modo que incumpla cualquier ley o reglamento nacional, federal, estatal, local o internacional aplicable;
- Con el objetivo de explotar, hacer daño o intentar explotar o hacer daño de cualquier modo a menores;
- Para generar o distribuir información y/o contenido que se pueda verificar que es falso con el objetivo de hacer daño a otras personas;
- Para generar o distribuir información de identificación personal que pueda utilizarse para hacer daño a un individuo;
- Para difamar, menospreciar o acosar de otro modo a otras personas;
- Para llevar a cabo una toma de decisiones totalmente automática que afecte de manera negativa a los derechos legales de un individuo o que cree o modifique de otro modo una obligación vinculante o aplicable;
- Para cualquier uso que esté destinado a o tenga el efecto de discriminar o dañar a individuos o grupos en función de su comportamiento social en línea o sin conexión o de unas características personales o de personalidad conocidas o predecibles;
- Para explotar cualquier vulnerabilidad de un grupo de personas concreto en función de su edad o de sus características sociales, físicas o mentales, con el fin de distorsionar de manera significativa el comportamiento de un persona que pertenece a ese grupo de un modo que provoque o pueda provocar daño físico o psicológico a dicha persona o a otra persona;
- Para cualquier uso que esté destinado a o tenga el efecto de discriminar a individuos o grupos en función de características o categorías protegidas legalmente;
- Para ofrecer asesoramiento médico e interpretación de resultados médicos;
- Para generar o distribuir información con el objetivo de que sea utilizada para la administración de justicia, el cumplimiento de la ley o los procesos de inmigración o asilo, como puede ser predecir que un individuo cometerá un fraude o un delito (p. ej., mediante la creación de perfiles de texto, trazando relaciones causales entre afirmaciones realizadas en documentos, mediante un uso indiscriminado y dirigido de forma arbitraria).

* GARANTÍA LIMITADA.
CyberLink garantiza que el medio por el que el SOFTWARE se vende está libre de defectos materiales y de mano de obra bajo un uso normal y durante noventa (90) días a partir de la fecha de entrega. Si hubiese algún defecto en el medio (CD/DVD-ROM), la única responsabilidad de CyberLink sería reemplazar el medio defectuoso siempre que se devolviese a CyberLink o al proveedor con su factura con fecha y se comprobase su defecto. En caso de que CyberLink no pueda reemplazar el medio defectuoso, CyberLink, a su propio criterio, le devolverá el dinero al finalizar esta licencia o reemplazará su software con una versión nueva.

ESTE SOFTWARE Y LA DOCUMENTACIÓN QUE LE ACOMPAÑA (INCLUYENDO LAS INSTRUCCIONES DE USO) SE FACILITAN "TAL CUAL" SIN GARANTÍA DE NINGÚN TIPO Y SIN PROTECCIÓN. ADEMÁS, SALVO QUE EN EL PRESENTE DOCUMENTO SE INDIQUE LO CONTRATIO, CYBERLINK NO AVALA, GARANTIZA O RESPALDA EN MODO ALGUNO NINGUNA CLÁUSULA REFERENTE AL USO, O LAS CONSECUENCIAS DEL USO, DEL SOFTWARE O SU DOCUMENTACIÓN EN TÉRMINOS DE CORRECCIÓN, EXACTITUD, CONFIABILIDAD, ACTUALIZACIÓN Y DEMÁS. USTED ASUME LA TOTALIDAD DEL RIESGO POR LOS RESULTADOS Y RENDIMIENTO DE ESTE SOFTWARE. SI EL SOFTWARE O LA DOCUMENTACIÓN SON DEFECTUOSOS, USTED, Y NO CYBERLINK NI SUS VENDEDORES, DISTRIBUIDORES, AGENTES O EMPLEADOS, ASUME EL COSTE TOTAL DEL SERVICIO, REPARACIÓN O CORRECCIÓN NECESARIOS.

CYBERLINK RECHAZA TODAS LAS DEMÁS GARANTÍAS SOBRE ESTE PRODUCTO DE CYBERLINK, EXPRESAS O IMPLÍCITAS, INCLUIDAS PERO NO LIMITADAS A LAS GARANTÍAS IMPLÍCITAS DE MERCANTIBILIDAD, ADAPTACIÓN PARA PROPÓSITOS PARTICULARES Y DE NO INFRACCIÓN, SIN INFLUIR SI HAN SIDO REALIZADAS O NO POR CYBERLINK. CYBERLINK NO GARANTIZA QUE EL SOFTWARE NO FALLE O TENGA ERRORES. NINGUNA INFORMACIÓN POR ESCRITO O AVISO OFRECIDO POR CYBERLINK, SUS VENDEDORES, DISTRIBUIDORES, AGENTES O EMPLEADOS CREARÁ UNA GARANTÍA O DE ALGÚN MODO AUMENTARÁ LOS LÍMITES DE ESTA GARANTÍA Y POR TANTO NO DEBE CONTAR CON TAL INFORMACIÓN O AVISO.

NI CYBERLINK NI NADIE MÁS QUE HAYA TOMADO PARTE EN LA CREACIÓN, PRODUCCIÓN O DISTRIBUCIÓN DE ESTE PRODUCTO SE HARÁ RESPONSABLE POR LOS DAÑOS DIRECTOS, INDIRECTOS, CONSECUENTES O INCIDENTALES (INCLUYENDO DAÑOS POR PÉRDIDA DE BENEFICIOS, INTERRUPCIÓN DEL NEGOCIO, PÉRDIDA DE DATOS U OTRA PÉRDIDA ECONÓMICA) QUE PROVENGAN DEL USO O LA INCAPACIDAD DE USO DE DICHO PRODUCTO AUN CUANDO CYBERLINK HAYA AVISADO DE LA POSIBILIDAD DE TALES DAÑOS. SIN PERJUICIO DE CUALQUIER COSA QUE INDIQUE LO CONTRARIO EN EL PRESENTE DOCUMENTO, LA RESPONSABILIDAD TOTAL DE CYBERLINK EN RELACIÓN CON CUALQUIER DEMANDA RELACIONADA CON O DERIVADA DE ESTE EULA NO SUPERARÁ EN NINGÚN CASO EL VALOR MONETARIO QUE USTED HAYA ABONADO A CYBERLINK POR LAS LICENCIAS APLICABLES EN VIRTUD DE ESTE EULA.

Si llegase a existir cualquier otra garantía, ésta deberá estar limitada en duración a noventa (90) días a partir de la fecha de entrega. La responsabilidad de CyberLink por los posibles daños hacia usted o cualquier otra persona no excederá bajo ningún concepto la cantidad pagada por la licencia para el uso del SOFTWARE.

Do not install or use the software until you have read and accepted all of the license terms. Permission to use the software is conditional upon your agreeing to the license terms. Installation or use of the software by you will be deemed to be acceptance of the license terms. Acceptance will bind you to the license terms in a legally enforceable contract with CyberLink Corp.

*CODEC ACTIVATION
When you use certain technologies essential to multi-media functions for the first time, the software application will collect the serial number of your computer system and the product key (CD key) for activation purposes only.

*PRIVACY POLICY
Some of our products may send an anonymous event/signal to CyberLink’s backend server to collect information for the purpose of improving the end user experience, such as for example:
-When user opts in or out of the CEIP (CyberLink Experience Improvement Program)/CPIP (CyberLink Product Improvement Program); and
-When our product is installed and/or uninstalled.

Please note that a trial version may also collect anonymous information and/or send crash report silently to CyberLink backend server for product improvement program.

CyberLink, as licensor, grants to you, the licensee, a non-exclusive right to download and/or install the accompanying PowerDirector software program(s) (hereinafter the "SOFTWARE") on a certain number of computer(s)/ device(s) in accordance with the number of the license(s) you purchased and use the SOFTWARE in accordance with the terms contained in this license. You agree and acknowledge that you may receive SOFTWARE update, upgrade notices or any commercial electronic messages during the use of SOFTWARE. You shall not rent, lease, sublicense, modify, alter, reverse engineer, disassemble, decompile, or create any derivative work of the SOFTWARE, or remove any copyright notice or proprietary legend contained in the SOFTWARE. You shall not reproduce the SOFTWARE unless for backup purposes and limited to one copy only. You acknowledge this SOFTWARE is licensed to you, not sold to you. The SOFTWARE must be lawfully acquired from CyberLink or through CyberLink’s authorized resellers otherwise you do not have a right to use the SOFTWARE. You agree that once SOFTWARE is operated, used or installed; you may not resell or distribute it to another person or entity subject to the relevant statutes. Whether you are legally allowed to resell the SOFTWARE will depend on the law of your place of residence or where the transferee is located. Generally a resale or distribution will cause an automatic termination of your license to use the SOFTWARE. You own and are responsible for the risks of inability to use or install the SOFTWARE in purchasing or obtaining the SOFTWARE NOT from CyberLink, CyberLink’s authorized distributors or resellers or for used SOFTWARE. License Types:
**INDIVIDUAL LICENSE
If you acquire the SOFTWARE under an individual license it is for your own use under the general terms above.
**SITE LICENSE
Site licensed SOFTWARE is licensed to be used in a single location. The maximum number of users is limited by the site license agreement.
**VOLUME LICENSE
Only one copy per device may be installed. If you are the volume license holder then you may make multiple back-up copies and install multiple seats of the SOFTWARE. The total number of licensed copies will be limited to a capped number according to the purchased quantity in bulk.
**EVALUATION/TRIAL LICENSE
Only one copy per device may be installed. The SOFTWARE is licensed for evaluation and/or trial purposes only. The rights granted to you herein will cease after a specified time period and the SOFTWARE usage is time limited, after expiration of which it may be disabled. This license is for non-commercial use.
**SUBSCRIPTION LICENSE
The SOFTWARE is licensed for subscription purposes. You agree that CyberLink may change the version of the SOFTWARE provided to you at any time without liability to you. Ongoing access to Subscription SOFTWARE requires a working internet connection, CyberLink’s receipt of recurring subscription payments and agreement to the terms of use and/or service for Subscription SOFTWARE to be found on the downloading site. The rights granted to you herein will cease after a specified time period and the SOFTWARE usage is time limited, after expiration of which it may be disabled.
**EDUCATIONAL LICENSE
The SOFTWARE is licensed for educational purposes and non-commercial use only. It may be purchased by schools, universities, students and their legal guardians, faculty, teachers, professors, lecturers and any other educational institutions, scholars or staff.
**H.265/HEVC LICENSE​
Please note the H.265/HEVC codec is not included in your SOFTWARE upon sale or installation, meaning the SOFTWARE is not yet qualified as an HEVC licensed product. In order to support your use of the H.265/HEVC format, you have to download and install the HEVC Video Extensions by following the instructions of the SOFTWARE.​

* UPGRADES
If this copy of the SOFTWARE is an upgrade from an earlier version of the SOFTWARE, it is provided to you on a license exchange basis. Upon your installation and use of this copy of the SOFTWARE, you agree to voluntarily terminate your earlier EULA and you will not continue to use the earlier version of the SOFTWARE or resell or distribute it to another person or entity.

* USE OF MEDIA CONTENT LICENSED BY THIRD PARTIES OR CYBERLINK
You may use templates, images, pictures, audio, video, thumbnails or other media content (“Media Content”), if any, provided in the SOFTWARE, which may be licensed from third parties or CyberLink, to demonstrate, complete or upload your work created by the use of the SOFTWARE to social media platforms; provided that
- Media Content shall remain in use on SOFTWARE;
- You shall not use the Media Content in any illegal, public performance or commercial or immoral manner;
- You shall not portray any person depicted in Media Content in a way that a reasonable person would find offensive, including but not limited to in connection with pornography, escort services, promotion of tobacco products, endorsement of a political party, or opinion, a physical or mental ailment;
- You shall not resell, redistribute, sublicense, provide access to, share, transfer or grant your right to use to any third party except as specifically provided in this EULA;
- You shall not use any Media Content (in whole or in part) as a trademark, service mark, logo, or other indication of origin, or as part thereof;
- You shall not falsely represent, expressly or by way of reasonable implication, that any Media Content was created by you or a person other than the copyright holder(s) of that Media Content; and/or
- You shall not use Media Content in connection with any content gallery from which people can search, discover and use the unaltered Media Content.
CyberLink does not provide any warranty or representation to the Media Content and disclaims all liabilities to the maximum extent allowed by law. Please note that the use of Media Content is subject to your purchase of SOFTWARE or a valid subscription.

* USE OF THE CONTENT LICENSED BY GETTY IMAGES (US), INC.
Subject to your compliance with the following provisions, you are authorized to use the content licensed from Getty Images (US), Inc. through the SOFTWARE (“Getty Images Content”) solely as incorporated into digital works created by you using the SOFTWARE.
You may download a watermarked, low-resolution version of Getty Images Content for no-fee, only for evaluation purposes, for a period of up to thirty (30) days following download by you. Unless you purchase licenses of Getty Images Content, you may not use any Getty Images Content in any final materials or any publicly available materials.
You may pay for a watermark-free, high-resolution version of Getty Images Content. Once you have purchased the license of a particular Getty Images Content via the SOFTWARE by paying applicable fees, you may use such licensed Getty Images Content an unlimited amount of times within the SOFTWARE and the works created by you using the SOFTWARE in accordance with the terms of this EULA.
You may not remove any metadata in Getty Images Content, activate the “right-click” function in Getty Images Content, or reverse engineer, decompile, disassemble the SOFTWARE to enable the download or use of Getty Images Content on a stand-alone basis. If technically feasible, you shall disable the “right-click” function in all items of Getty Images Content. You may not use Getty Images Content in any way that allows others to download, extract, or redistribute Getty Images Content as a stand-alone file (meaning just the content file itself, separate from the works created by you using the SOFTWARE or end use).
You may only use Getty Images Content in the works created by you using the SOFTWARE, for display solely in digital form. You may not sell, resell, distribute, modify, re-use, display, reproduce or make any other use of Getty Images Content.
Getty Images Content may be used in non-editorial works created via the SOFTWARE more than once in or in connection with the same non-editorial work, provided such usage otherwise complies with this EULA.
Getty Images Content used in an editorial context must include the following credit line: "[Photographer's Name]/[Collection Name]/[Getty Images or iStock]".
Getty Images Content may not be used:
- for pornographic, defamatory or other unlawful purposes;
- on a stand-alone basis with no other content;
- in electronic templates used to create electronic or printed products;
- in physical or digital retail products, such as e-cards, calendars, posters, or screensavers;
- for the purpose of enabling file-sharing of the image file; or
- in logos, trademarks, services marks or any other branding or identifiers.
If you use Getty Images Content that features an individual(s) in connection with a sensitive, unflattering or controversial subject, you must include a statement that the Getty Images Content is used for illustrative purposes only and the individual is a model.
No ownership or copyrights to Getty Images Content are granted to you.
If you misuse any Getty Images Content, CyberLink will enforce the terms of this EULA, investigate and address such misuse, whether by shutting down your access and/or as may otherwise be appropriated in the given circumstance.
You are also authorized to use the music content/soundstripe licensed from Getty Images (US), Inc. through the SOFTWARE (“Getty Music Content”) solely as incorporated into digital works created by you using the SOFTWARE. You shall have the same usage rights for Getty Music Content that are set forth above for Getty Images Content, provided, however (i) in addition to the terms set forth above, you cannot in any event use Getty Music Content contrary to the restrictions set forth in Section 3 of Getty Image Music License Agreement (see: https://www.gettyimages.com/eula), and (ii) you cannot use Getty Music Content in any products for resale or electronic templates (including video templates).

* USE OF DERIVATIVES OF THE STABLE DIFFUSION MODEL
For our Service incorporated with Stable Diffusion models, the following user restrictions apply (for more details of Stable Diffusion License terms, please see: https://huggingface.co/spaces/CompVis/stable-diffusion-license). You agree not to use our Service:
- in any way that violates any applicable national, federal, state, local or international law or regulation;
- for the purpose of exploiting, harming or attempting to exploit or harm minors in any way;
- to generate or disseminate verifiably false information and/or content with the purpose of harming others;
- to generate or disseminate personal identifiable information that can be used to harm an individual;
- to defame, disparage or otherwise harass others;
- for fully automated decision making that adversely impacts an individual's legal rights or otherwise creates or modifies a binding, enforceable obligation;
- for any use intended to or which has the effect of discriminating against or harming individuals or groups based on online or offline social behavior or known or predicted personal or personality characteristics;
- to exploit any of the vulnerabilities of a specific group of persons based on their age, social, physical or mental characteristics, in order to materially distort the behavior of a person pertaining to that group in a manner that causes or is likely to cause that person or another person physical or psychological harm;

* LIMITED WARRANTY
CyberLink warrants the media on which the SOFTWARE is furnished to be free of defects in material and workmanship, under normal use, for a period of ninety (90) days following the date of delivery to you. If there is a defect in the media (CD/DVD-ROM), CyberLink's sole liability shall be to replace the defective media, which has been returned to CyberLink or the supplier with your dated invoice and is shown to be defective. In the event that CyberLink is unable to replace defective media, CyberLink shall at its sole discretion either refund your money upon your termination of this license or replace it with the newer version of the same software.

THIS SOFTWARE AND ACCOMPANYING DOCUMENTATION (INCLUDING INSTRUCTIONS FOR USE) ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND AND ARE NOT FAIL-SAFE. Should any other warranties be found to exist, such warranties shall be limited in duration to ninety (90) days following the date of delivery to you. In no event will CyberLink's liability for any damages to you or any other person exceed the amount paid for the license to use the SOFTWARE.

You agree to bear the full, complete, and sole responsibility for using the SOFTWARE for any purpose. You also agree to indemnify and hold CyberLink harmless from any claims, proceedings, damages, costs, and expenses resulting from your use of the SOFTWARE for any illegal purpose or violation of this EULA.

Upon termination of this EULA, you should destroy the SOFTWARE and the Documentation and all the copies thereof and remove and delete the SOFTWARE from your hard disk or other storage device.

This EULA constitutes the entire agreement between you and CyberLink Corp. This EULA shall be governed and construed in accordance with the laws of Taiwan and shall benefit CyberLink, its successors and assigns.

Any claim or dispute between you and CyberLink or against any agent, employee, successor or assign of CyberLink, whether related to this EUL A or otherwise, and any claim or dispute related to this EULA or the relationship or duties contemplated under this EULA, including the validity of this arbitration clause, shall be resolved in Taipei, Taiwan, pursuant to the Taiwan Arbitration Act.

This localized version of the EULA is for reference only. In case of inconsistencies between the localized version and the English version, the English version will prevail.
