라이센스 유형:
**개별 라이센스
개인 라이센스 하에서 소프트웨어를 획득한 경우 라이센스는 위에 나온 일반 약관에 따라 귀하 자신의 사용을 위한 것입니다.
**사이트 라이센스
사이트 라이센스 소프트웨어는 단일 위치에서 사용하도록 라이센스가 부여됩니다. 최대 사용자 수는 사이트 라이센스 계약에 의해 제한됩니다.
**볼륨 라이센스
장치당 한 개의 사본만 설치할 수 있습니다. 볼륨 라이센스 소유자인 경우에는 소프트웨어의 여러 백업 사본을 만들어 여러 자리에 설치할 수 있습니다. 라이센스가 부여된 사본의 총 수는 대량 구매 수량에 의해 제한됩니다.

**H.265/HEVC 라이선스
판매 또는 설치 당시 H.265/HEVC 코덱은 소프트웨어에 포함되어 있지 않습니다. 즉, 소프트웨어가 아직 HEVC 라이선스된 제품의 자격을 갖지 못했다는 의미입니다. H.265/HEVC 형식의 사용을 지원하기 위해, 귀하는 소프트웨어 지침에 따라 HEVC 비디오 확장을 다운로드하고 설치해야 합니다.

**추가적인 라이선스 요구 사항
소프트웨어를 직접 수익 발생 용도에 사용하려는 경우 또는 귀하를 위해 수익을 발생시키는 주요 자원 역할을 하게 하려는 경우에는 다음 비정성적 목록에 나온 제3자 기술에 대한 추가 라이센스가 필요합니다.

* 제3자 또는 CYBERLINK에 의해 라이센스된 미디어 콘텐츠의 이용
귀하는 본 소프트웨어를 사용함으로써 만들어지는 귀하의 작업을 설명 또는 완료하기 위해, 제3자 또는 CyberLink로부터 사용 허가를 받을 수도 있는 본 소프트웨어에 제공된 템플릿, 이미지, 사진, 오디오, 비디오, 썸네일 또는 기타 미디어 콘텐츠(미디어 콘텐츠)를 다음 조건 하에서 이용할 수 있습니다.
- 미디어 콘텐츠가 소프트웨어 상의 사용으로 남아야 합니다;
- 미디어 콘텐츠를 귀하가 불법적, 대중에 공연, 상업적 또는 비도덕적 방식으로 사용하지 않습니다;
- 보통 사람이 볼 때 모욕적으로 느낄 수 있는 방식으로 미디어 콘텐츠에서 사람을 묘사해서는 안 됩니다. 여기에는 포르노, 에스코트 서비스, 담배 제품 홍보, 의견 또는 정당에 대한 지지, 육체적 정신적 질병의 고통과의 연계가 포함되며 이에 제한되지 않습니다;

CyberLink는 미디어 콘텐츠에 대해 어떠한 보증 또는 표현도 제공하지 않으며 법률이 허용하는 최대 한도까지 책임을 부인합니다. 미디어 콘텐츠의 사용은 귀하의 소프트웨어 구매 또는 유효한 구독의 적용을 받습니다.

* GETTY IMAGES (US), INC.에 의해 라이센스된 콘텐츠의 이용
귀하가 다음의 조항을 준수하는 한, 귀하는 소프트웨어를 통해 Getty Images (US), Inc.로부터 라이센스를 받은 콘텐츠(“Getty Images 콘텐츠”)를 소프트웨어를 사용하여 귀하에 의해 생성된 디지털 제작물에 병합된 대로만 사용하도록 권한이 부여됩니다.
귀하는 워터마크가 있는 저해상도 버전의 Getty Images 콘텐츠를 평가 목적으로만 무료로 다운로드할 수 있으며, 다운로드한 날로부터 최대 삼십(30) 일 동안 사용할 수 있습니다. Getty Images 콘텐츠의 라이센스를 구매하지 않는 한, 귀하는 어떠한 최종 자료 또는 공공이 이용할 수 있는 자료에서도 Getty Images 콘텐츠를 사용해서는 안 됩니다.
귀하는 워터마크 없는 고해상도 버전의 Getty Images 콘텐츠를 구매할 수 있습니다. 소프트웨어를 통해 해당 비용을 지불하여 특정 Getty Images 콘텐츠에 대한 라이센스를 구매하고 나면, 귀하는 이 EULA의 조항에 따라 그러한 라이센스된 Getty Images 콘텐츠를 소프트웨어 내에서 또는 소프트웨어를 사용하여 귀하가 생성한 제작물 내에서 무제한 시간 동안 사용할 수 있습니다.

개인의 특징을 이루는 Getty Images 콘텐츠를 민감하거나, 불쾌하거나 논란이 있는 주제와 연관지어 사용하는 경우, 귀하는 Getty Images 콘텐츠는 단지 보여주기 위한 목적으로 사용되는 것이고 개인은 모델이라는 점을 명시해야 합니다.
Getty Images 콘텐츠에 대한 소유권 또는 저작권은 귀하에게 부여되지 않습니다.
귀하가 Getty Images 콘틴츠를 오용하는 경우, CyberLink는 EULA의 조항을 시행하고, 해당 오용을 조사하여 귀하의 접근을 차단시키고 및/또는 주어진 상황에서 그 밖의 방식으로 조치될 수 있습니다.
귀하는 또한 소프트웨어를 통해 Getty Images (US), Inc.로부터 라이선스를 받은 음악 콘텐츠/사운드스트라이프(“Getty Music 콘텐츠”)를 소프트웨어를 사용하여 귀하에 의해 생성된 디지털 제작물에 병합된 대로만 사용하도록 권한이 부여됩니다. 귀하는 Getty Images 콘텐츠에 대해 위에 명시된 것과 동일한 사용 권한을 가지게 됩니다. 단, (i) 위에 명시된 조건에 더하여, 귀하는 어떠한 경우에도 Getty Image 음악 라이선스 계약(참고:https://www.gettyimages.com/eula)의 섹션 3에 명시된 제한 사항에 반하여 Getty Music 콘텐츠를 사용할 수 없습니다. * STABLE DIFFUSION 모델의 파생물 사용
Stable Diffusion 모델이 통합되어 있는 당사 서비스의 경우, 다음과 같은 사용자 제한이 적용됩니다(Stable Diffusion 라이선스 조건에 대한 자세한 내용은 여기를 참조: https://huggingface.co/spaces/CompVis/stable-diffusion-license). 귀하는 당사 서비스를 다음과 같이 사용하지 않을 것임에 동의합니다.
- 어떤 식으로든 관련 국가, 연방, 주, 지방 또는 국제 법률이나 규정을 위반하여 사용;
- 미성년자를 착취 또는 해를 끼칠 목적으로, 또는 미성년자를 착취 또는 해를 끼치려는 시도에 사용;
- 다른 사람에게 해를 끼칠 목적으로 검증 가능한 허위 정보 및/또는 콘텐츠를 생성하거나 유포하기 위해;
- 개인에게 해를 끼치는 데 사용될 수 있는 개인 식별 정보를 생성하거나 유포하기 위해;
- 다른 사람의 명예를 훼손하거나 비방하거나 기타 방식으로 괴롭히기 위해;
- 개인의 법적 권리에 부정적인 영향을 미치거나 구속력 있고 집행 가능한 의무를 생성하거나 수정하는 완전히 자동화된 의사 결정을 위해;
- 온라인 또는 오프라인 사회적 행동, 또는 알려졌거나 예측되는 개인 또는 성격 특성을 바탕으로 개인 또는 그룹을 차별하거나 해를 입히려는 의도 또는 그러한 효과가 있는 사용;
- 연령, 사회적, 신체적 또는 정신적 특성을 바탕으로 특정 그룹의 취약성을 악용하여, 해당 개인 또는 다른 사람의 신체적 또는 정신적 피해를 유발하거나 유발할 가능성이 있는 방식으로 해당 그룹에 속한 개인의 행동을 실질적으로 왜곡하는 행위;
- 법적으로 보호되는 특성 또는 범주를 바탕으로 개인 또는 그룹을 차별하려는 의도가 있거나 그러한 효과가 있는 사용;
- 의학적 조언 및 의학적 결과 해석을 제공하기 위해;
- 개인이 사기/범죄를 저지를 것이라고 예측하는 경우처럼, 사법, 법 집행, 이민 또는 망명 절차 관리에 사용할 목적으로 정보를 생성하거나 전파(예: 텍스트 프로파일링, 문서에서 이루어진 주장 사이의 인과 관계 도출, 무차별 및 임의 대상 사용에 의해).

* 제한적 보증.
사이버링크는 본 소프트웨어가 귀하에 인도된 날로부터 90일 동안 정상적인 사용중에 본 소프트웨어가 제공된 매체가 재질 및 기능에 있어 결함이 없다는 것을 보증합니다 만일 매체에 결함이 있으면, 사이버링크의 단독 책임 하에 날짜가 적힌 송장과 함께 결함이 있는 매체 (CD/DVD-ROM) 를 사이버링크 또는 공급자에게 반송하면 교환해드리겠습니다. 사이버링크사가 손상된 CD를 교환해 줄수 없는경우에 ,사이버링크사는 귀하가 라이센스를 끝내는조건으로 현금으로 보상하거나동일 소프트웨어의 최신판으로 교환해 줄수 있습니다.

*CODEC ACTIVATION
When you use certain technologies essential to multi-media functions for the first time, the software application will collect the serial number of your computer system and the product key (CD key) for activation purposes only.

*PRIVACY POLICY
Some of our products may send an anonymous event/signal to CyberLink’s backend server to collect information for the purpose of improving the end user experience, such as for example:
-When user opts in or out of the CEIP (CyberLink Experience Improvement Program)/CPIP (CyberLink Product Improvement Program); and
-When our product is installed and/or uninstalled.

Please note that a trial version may also collect anonymous information and/or send crash report silently to CyberLink backend server for product improvement program.

License Types:
**INDIVIDUAL LICENSE
If you acquire the SOFTWARE under an individual license it is for your own use under the general terms above.
**SITE LICENSE
Site licensed SOFTWARE is licensed to be used in a single location. The maximum number of users is limited by the site license agreement.
**VOLUME LICENSE
Only one copy per device may be installed. If you are the volume license holder then you may make multiple back-up copies and install multiple seats of the SOFTWARE. The total number of licensed copies will be limited to a capped number according to the purchased quantity in bulk.
**EVALUATION/TRIAL LICENSE
Only one copy per device may be installed. The SOFTWARE is licensed for evaluation and/or trial purposes only. The rights granted to you herein will cease after a specified time period and the SOFTWARE usage is time limited, after expiration of which it may be disabled. This license is for non-commercial use.
**SUBSCRIPTION LICENSE
The SOFTWARE is licensed for subscription purposes. You agree that CyberLink may change the version of the SOFTWARE provided to you at any time without liability to you. Ongoing access to Subscription SOFTWARE requires a working internet connection, CyberLink’s receipt of recurring subscription payments and agreement to the terms of use and/or service for Subscription SOFTWARE to be found on the downloading site. The rights granted to you herein will cease after a specified time period and the SOFTWARE usage is time limited, after expiration of which it may be disabled.
**EDUCATIONAL LICENSE
The SOFTWARE is licensed for educational purposes and non-commercial use only. It may be purchased by schools, universities, students and their legal guardians, faculty, teachers, professors, lecturers and any other educational institutions, scholars or staff.
**H.265/HEVC LICENSE​
Please note the H.265/HEVC codec is not included in your SOFTWARE upon sale or installation, meaning the SOFTWARE is not yet qualified as an HEVC licensed product. In order to support your use of the H.265/HEVC format, you have to download and install the HEVC Video Extensions by following the instructions of the SOFTWARE.​

- You shall not resell, redistribute, sublicense, provide access to, share, transfer or grant your right to use to any third party except as specifically provided in this EULA;
- You shall not use any Media Content (in whole or in part) as a trademark, service mark, logo, or other indication of origin, or as part thereof;
- You shall not falsely represent, expressly or by way of reasonable implication, that any Media Content was created by you or a person other than the copyright holder(s) of that Media Content; and/or
- You shall not use Media Content in connection with any content gallery from which people can search, discover and use the unaltered Media Content.
CyberLink does not provide any warranty or representation to the Media Content and disclaims all liabilities to the maximum extent allowed by law. Please note that the use of Media Content is subject to your purchase of SOFTWARE or a valid subscription.

Subject to your compliance with the following provisions, you are authorized to use the content licensed from Getty Images (US), Inc. through the SOFTWARE (“Getty Images Content”) solely as incorporated into digital works created by you using the SOFTWARE.
You may download a watermarked, low-resolution version of Getty Images Content for no-fee, only for evaluation purposes, for a period of up to thirty (30) days following download by you. Unless you purchase licenses of Getty Images Content, you may not use any Getty Images Content in any final materials or any publicly available materials.
You may pay for a watermark-free, high-resolution version of Getty Images Content. Once you have purchased the license of a particular Getty Images Content via the SOFTWARE by paying applicable fees, you may use such licensed Getty Images Content an unlimited amount of times within the SOFTWARE and the works created by you using the SOFTWARE in accordance with the terms of this EULA.
You may not remove any metadata in Getty Images Content, activate the “right-click” function in Getty Images Content, or reverse engineer, decompile, disassemble the SOFTWARE to enable the download or use of Getty Images Content on a stand-alone basis. If technically feasible, you shall disable the “right-click” function in all items of Getty Images Content. - in any way that violates any applicable national, federal, state, local or international law or regulation;

- to generate or disseminate personal identifiable information that can be used to harm an individual;

Should any other warranties be found to exist, such warranties shall be limited in duration to ninety (90) days following the date of delivery to you. In no event will CyberLink's liability for any damages to you or any other person exceed the amount paid for the license to use the SOFTWARE.

You agree to bear the full, complete, and sole responsibility for using the SOFTWARE for any purpose. You also agree to indemnify and hold CyberLink harmless from any claims, proceedings, damages, costs, and expenses resulting from your use of the SOFTWARE for any illegal purpose or violation of this EULA.

Upon termination of this EULA, you should destroy the SOFTWARE and the Documentation and all the copies thereof and remove and delete the SOFTWARE from your hard disk or other storage device.

This EULA constitutes the entire agreement between you and CyberLink Corp. This EULA shall be governed and construed in accordance with the laws of Taiwan and shall benefit CyberLink, its successors and assigns.

Any claim or dispute between you and CyberLink or against any agent, employee, successor or assign of CyberLink, whether related to this EUL A or otherwise, and any claim or dispute related to this EULA or the relationship or duties contemplated under this EULA, including the validity of this arbitration clause, shall be resolved in Taipei, Taiwan, pursuant to the Taiwan Arbitration Act.

This localized version of the EULA is for reference only. In case of inconsistencies between the localized version and the English version, the English version will prevail.
